Part 2: What documents we require to make a rent contract with us?

This article, unlike the first one, focuses on leases.

Documentation to be provided when you are signing the rent contract (asterisks indicate that this is not always compulsory)


In case you are an owner we will ask you for the following data:

The certificate of habitability: without it you can not register the supplies we explain in this link.

The certificate of energy efficiency: it is obligatory to sell or rent according to the Royal Decree 235/2013. 

The title of property: to identify with all certainty that who claims to be the property is really

              In case you are a tenant:

You can be: 

1. A salaried person then we will ask you for the following documentation:

ID card of the owner, his/her spouse or his/her *guarantor (if you have any)

 Three final pay slips to act as proof of your present and future ability to pay

 Income tax from the previous year

 Bank account with copy of bank receipt

 * Last three rent receipts paid  

 * Employment contract (for less than one year): .

            2. A self-employed individual will then be asked to provide the following documentation:            

 The tenant ID card, his/her spouse or *guarantor (if you have any) 

The income tax for the current year (form 130 and 131)

 Quarterly VAT returns for the current year (form 303)

 The income tax of the previous year

 The bank account (with a copy of the bank receipt)

3. A company we will then ask you for the following documentation:

 The CIF of the company

 The Deed of Incorporation

 The Scripture of the Powers

 The ID card of the proxy

 A letter of good business relations with the bank

 The bank account (with a copy of the bank statement)

 The annual VAT summary (model 390)

 Last year's corporate tax

The Balance Sheet of the Current Year

How should you make an inventory of what is in the property at the time of signing the lease?

It is necessary to enumerate: what you have, to know its state and to estimate its value (better to document the inventory with pictures or videos) 

3. As a tenant should you visit the apartment before signing?

Always, just like the owner as a tenant, you have the right to check that there are no damages before you enter. If you see any damage, you must inform the owner in writing: four years ago we explained this. 

4. Why does the law require that the amount of the deposit be stated in the contract?

That which is not written down in a contract is not a reliable obligation, as the deposit is, its amount must always be stated in the contract. 

5. I am already a tenant, should I put the supplies in my name?

No. It is essential to do so to avoid supply cuts and conflicts with the property.  First of all, you must check that the exact address for sending correspondence and invoices is given. Attention, in case of errors please contact the supply company immediately.  At this point, you must make the change of ownership or register supplies (as the case may be).
